Au-delà de son sujet - l'indemnité contractuelle dans les contrats publics impliquant un financement externe - le présent ouvrage poursuit un double objet, qui en constitue la trame : rendre compte de l'importance de la finance, et plus particulièrement, de la finance d'entreprise, dans le monde d'aujourd'hui, notamment dans le droit des contrats publics ; révéler l'existence d'un méta-système juridique en marge du système institutionnel : celui qu'organise le Parlement, celui qu'applique le juge, celui que commente la doctrine. Ce méta-système s'est construit dans les directions juridiques des grandes entreprises, désormais très internationalisées et dans les cabinets d'avocats, dont un grand nombre d'origine anglo-saxonne.
